The Cayman trust law takes after the English Trustee Act of 1925 and the Variation of Trusts Act of 1958, with most of the characteristic provisions, which are uncharacteristic to the offshore jurisdictions. The main statues that affect the Cayman Island trusts are the Trusts Law of 1996, the Perpetuities Law of 1995 and the Fraudulent Dispositions Law of 1989. This being said, the Caymans themselves are always updating their trust statues with the Purpose Trust legislation planned.
The Cayman’s eliminated the Rule Against Perpetuities in 1995; however, the Perpetuity period is 150 years for dispositions from those trusts created before 1995. The law does recognize choice-of-law clauses in trusts.
