This article is going to discuss what fraudulent conveyance is and how it pertains to your offshore accounts. This is an important term that you should know when thinking about putting your money in a bank account in Panama.

A fraudulent conveyance is a claim that an attorney can make against you in a civil suit. What happens is as follows:

  • You get taken to court for some reason or another and the judge awards the other party some portion of your money.
  • You move your valuable assets to an offshore account which cannot be tracked in an effort to save your belongings.
  • Now you go back to court and say that you cannot pay the amount asked for and that the other party misrepresented how much in assets you actually had to the judge.
  • The attorney, suspicious of you mysteriously losing possessions, thinks you are up to something and claims that you moved all of your assets to an offshore account to avoid paying a judgment

 

 

 

 

 

 

 

So now do you think that the court can send someone to Panama to ask for your assets back? Not without a fight they can’t! When they go to Panama they will be faced with resistance from all over. First off, Panama will not cooperate unless you have been prosecuted in your home country. Even then they need proof that this money or evidence is needed to build a case, which isn’t ever easy to do. Finally, the prosecution will have to fight through your own lawyers.
Remember that if you put all your money in a Foundation or a corporation that does not bear your name, it is much harder for the assets to be linked to you. Panama encourages this type of action and will help your protect your valuables. Take full advantage of the country and you will be find against threats like this.

It is very hard for prosecutors to get anything against you in Panama. They cannot make your life miserable by freezing your assets and accounts because they cannot acknowledge you have any, and even if they can Panama courts won’t do it anyways. They can’t gain the cooperation of the government as Panama does not want to help foreign countries, only their own.

As long as you plan ahead, think smart and take the advice of those who know what they are doing, you will never face any problems when banking offshore in Panama. Sure some people may ask and try to convince you to give up your assets, but you don’t have to and shouldn’t give in to the pressure.
